Gun Free Zone Ordinance - Future Agenda Item
Fernley City Council Meeting 11-18-15 Item#: 16.D.
Proposed By: Councilman Cal Eilrich
Special Note To Citizens:
The agenda item that I have requested regarding "Gun Free Zones" is an initial procedure that enables the council to hear my individual reasoning to justify having an actual future agenda item.
This procedure ensures that one council member cannot overload staff with council agenda requests without approval of the majority of the council. Therefore, the council cannot actually discuss or deliberate details of Gun Free Zones, and there will be no public input specifically for this item at this time.
However, the public can comment during the normal Public Input periods at both the beginning and end of the meeting.
If a majority of the city council votes to officially hear this item on a future agenda, staff will thereby be directed to prepare proper staff reports. Staff's preparation may range from asking council for further direction, clarification, and consensus to proceed further, to actually preparing a draft ordinance.
Please understand that we are regulated by State of Nevada Open Meeting Laws, which protect the public's right to be aware of whatever this city council discusses and to be heard.
Reasoning to Support a Discussion & Action Item Regarding Gun Free Zones:
I have been gravely concerned for years regarding declared "Gun Free Zones", in public facilities operated by both governmental and private entities. These declared "Gun Free Zones" amount to an invitation to a "Killing Field" for everything from one mentally disturbed individual all the way up to organized groups of criminals or which is now becoming a more grave concern for our nation, Islamic Terrorists.
Almost all mass-shootings have been committed in so-called Gun Free Zones.
I believe that any entity that is going to declare a Gun-Free Zone, should also take the responsibility of providing adequate security for those who they are forcing to disarm, which in affect causes them to surrender their own personal means of self-defense.
There are two types of public facilities:
Type One Facility:
A governmental or private publicly accessible facility where members of the public have no alternative but to enter for critical services, such as but not limited to governmental services, health and welfare services, emergency medical, or participation in governmental meetings, like this meeting, of which all citizens are entitled to attend.
Type Two Facility:
A private facility wherein, customers do have a viable alternative to receive similar services.
Proposal: A City of Fernley Ordinance that would require the following:
Type One Facility:
For a Type One Facility to post "Gun Free Zone" or "Weapons Prohibited" signs, the management of that facility must have in place, a written and implemented security plan complete with trained-armed security officers, either uniformed or preferably undercover. There shall be a minimum of one such security officer for the first 1 to 100 occupants of the facility, plus a minimum of one such security officer for each 100 occupants after the first 100. Special events or meetings are required to provide additional temporary security officers, if occupant numbers exceed normal operations.
If such security measures are not planned and provided for, then no "Gun Free Zone" or "Weapons Prohibited" signs can be posted at the facility, which then provides for lawfully armed citizens the right to defend themselves.
Type Two Facility:
For a Type Two Facility to post "Gun Free Zone" or "Weapons Prohibited" signs, the management of that facility must have in place, a written and implemented security plan complete with trained-armed security officers, either uniformed or preferably undercover. There shall be a minimum of one such security officer for the first 1 to 100 occupants of the facility, plus a minimum of one such security officer for each 100 occupants after the first 100. Special events or meetings are required to provide additional temporary security officers, if occupant numbers exceed normal operations.
If such security measures are not planned and provided for, then the private facility must also post a notice directly beneath, and the same size, a sign that states, "No Armed Security On-Site".
Personal Statement:
It's no secret that I have been dedicated to shooting sports and firearms safety education since 1968. I've had the honor of being a world-class competitive shooter in 4 major shooting sports, holding numerous titles and world records. I still actively compete and administrate the sport of Cowboy Fast Draw. Many of my accomplishments can be found on the internet.
I have also been a long time firearm instructor for competitive shooting sports, private security and law enforcement. I am committed to the education of as many people as possible in the safe and proper use of firearms. I also believe that an armed society is a polite society, as long as firearm safety rules, laws and common courtesy are obeyed by responsible citizens.
Note: Even though I have authored numerous articles for magazines and countless competitive shooting regulations and rules for three competitive shooting sports, I am not an attorney. Therefore, I doubt my actual wording will survive into what may become an ordinance, providing a majority of my counterparts support such an ordinance. I do hope that if such an ordinance is created, that it can serve as an example for cities and other governmental entities across our nation.

This meeting drew hundreds of citizens and was standing room only. I'm glad that the citizens were paying attention. Of course, social media outlets (Facebook) blew this way out of proportion with out the facts. Although I don't blame folks for jumping to conclusions, since the Government at almost all levels are trying to take our gun right away.
This meeting ended up very positive with a 5-0 vote to move forward with an actual agenda item to work out details. I also received a call from the NRA's Lead Attorney handling legislative affairs, who supports my views and would like input into this ordinance.
This made front page news in local newspapers...

Good for you. I am 100% in agreement. In Ohio there are a number of challenges to current thinking of expanding concealed carry. House Bill 48: Sponsored by Representative Ron Maag (R-62), HB 48 would expand the locations concealed handgun permit holders are allowed to carry to include (but not limited to) churches, state buildings and school safety zones (granted the firearm remains within the car). Universities and colleges would be given the choice under this legislation.

Its a start, but there is a long way to go. I think we need to push for open carry in every instance over the next several decades.
I have been looking for some thoughts about the Cowboy Way and haven't seen too much on it here. But to me, part of the romance and thrill of the Old West is that the gun represented laissez faire capitalism, and that protections and emphasis on private property is the kind of thinking that most defines American life. So with that in mind, wearing a gun would be as common as wearing a tie to a business meeting. Its not just for personal protection, but an affirmation of economic value.
Just a thought.

Frankly, I'm not a huge proponent of "Open Carry" in highly traveled and populated areas. I know some folks think that Open Carry should be right that is allowed anywhere anytime. I don't necessarily believe that this is a very intelligent viewpoint. The reason is that in today's society there are far too many people who fear the sight of any firearm, due to societal ignorance.
Why? There has been almost a total lack of firearm education available in our society in the past several decades. This has been promoted by misguided liberal policies. Gone are the days, in many cases, when a father taught their children about safely handling firearms. In our education system, they will teach our children about drugs, sex, homosexuality, driving, computers, and it seems very little about reading, writing, history and arithmetic. But, when it comes to firearms, our education system buries their head in the sand and pretends and believes that the world would be a better place without firearms.
Just ask a simple question to liberals who actually believe this propaganda, "Was the world a less violent place, before the firearm was invented about 500 years ago?" If they say that it was, it demonstrates their total lack of education in World History.
Some people fear guns. A person's fear should be respected. Imagine a person that is afraid of a snake or a spider. Would you dare to push one in their face? The fear of seeing a gun in a public place is no different to the people who are ignorant about firearms and fear them.
As a firearm and security instructor, I believe that wearing an exposed firearm that you plan to use for self-defense is a pour strategy. Maintaining stealth is a primary component to self-defense. if you advertise that you are armed by displaying a firearm, you may in fact detour an untrained non-professional criminal, but it will also serve to make you the primary target for a trained professional.
